These Terms of Use (“Terms”) are an agreement between you and Sergii Nazaruk (“we”, “us”) for the FastSweep - Easy Scan & Clean iPhone app and this website (together, the “Service”). By downloading, installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, as permitted by the Apple Media Services Terms and Conditions and these Terms. Apple's standard Licensed Application End User License Agreement applies to the App, except where these Terms add to it.
You may not copy, modify, reverse engineer, decompile, rent, lease, resell or create derivative works from the App, except where the law allows it despite this restriction.
Eligibility
You must be old enough to enter a binding agreement where you live. If you are under the age of majority, use the Service only with the involvement of a parent or guardian.
Your photos, videos and backups
You keep all rights in your photos, videos and other content. The App only works with content stored on your device and only with the permission you give.
Cleaning and compressing can remove or change files. Review every selection before you confirm. Deleted items may stay in the “Recently Deleted” album of the Photos app for a period set by Apple, after which they are permanently removed. Compressed videos are new, smaller versions and may differ in quality from the originals. Back up anything important before you delete or compress it. You are responsible for your own backups.
Secret Space and your PIN
Secret Space is protected by a PIN you choose. Keep your PIN confidential. We cannot see or reset your PIN, and if you forget it or delete the App you may lose access to the media stored in Secret Space. Please keep copies of anything you cannot afford to lose.
Purchases and subscriptions
Some features may require payment, including auto-renewable subscriptions. Prices, billing periods and any free trial are shown before you confirm a purchase. Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period at the price shown at purchase.
- Manage or cancel a subscription in Settings > [your name] > Subscriptions on your iPhone.
- If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
- Refunds are handled by Apple under its policies. Request one through Apple's “Report a Problem” page.
Acceptable use
Use the Service lawfully and only with content you have the right to manage. Do not interfere with the Service, attempt to bypass any access or payment control, or use it to harm others or to store unlawful content.
Our intellectual property
The App, its design, text, graphics, icon, name and code belong to us or our licensors and are protected by copyright, trademark and other laws. These Terms give you no ownership in them.
Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows. We do not guarantee that the App will find every duplicate or similar file, that results or size estimates will be exact, or that it will run without interruption or errors.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, files, profits or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose, or USD 50 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, and you may have consumer rights that these Terms cannot remove.
Ending your use
You can stop using the Service at any time by deleting the App. We may suspend or end access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination will do so.
Apple's role
These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content, maintenance and support, and for any claims about it. Apple has no obligation to provide maintenance or support. If the App fails to meet a legal warranty, you may notify Apple for a refund of the purchase price, and to the extent the law allows Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. embargo and are not on a U.S. list of restricted parties.
Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Courts in Kyiv, Ukraine have jurisdiction, unless mandatory consumer protection law in your country of residence gives you the right to bring a claim elsewhere.
Changes to these Terms
We may update these Terms. The “Effective” date shows the latest version. If you keep using the Service after a change takes effect, you accept the updated Terms.
